Commissioning Agents verify that complex building systems—such as HVAC, electrical, and plumbing—operate according to the owner's project requirements and the design intent. Because they serve as the final quality control before a building is occupied, Commissioning Agent insurance is designed to address the professional risks of system performance and operational efficiency, subject to the terms, conditions, exclusions, and limitations of the policy issued.

1. Professional Liability & Spatial Accuracy

Coverage is structured to address claims arising from alleged errors in the commissioning process, such as failing to identify a defective sensor or an improperly balanced air system. If a building’s systems fail to perform or consume excessive energy due to a missed commissioning step, this coverage addresses the resulting financial claims.

2. Delay & Occupancy Risk

Commissioning occurs during the critical final phase of construction. Policies may address liability stemming from alleged professional negligence that causes delays in obtaining a Certificate of Occupancy, which can lead to significant financial penalties or lost revenue for the building owner.

3. General Liability & On-Site Testing

Commissioning agents are "hands-on" professionals who interact with live electrical panels, boilers, and roof-mounted equipment. General Liability provides protection for third-party bodily injury or property damage—such as accidentally causing a system surge or a water leak during functional performance testing—occurring on-site.

4. Post-Occupancy & Warranty Review

Many agents perform 10-month warranty inspections or ongoing commissioning. Coverage placement considers the professional liability associated with these long-term assessments and the potential for late-discovery claims regarding latent system defects.
